Welcome to AItemizeIT!

These Terms of Service ("Terms") govern your use of the AItemizeIT mobile application and web services. By using AItemizeIT, you agree to these Terms. Please read them carefully.

1. Acceptance of Terms

By creating an account, downloading, installing, or using AItemizeIT ("the App"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, do not use the App.

2. Description of Service

AItemizeIT is a household inventory management application that allows you to:

Catalog and organize your personal property, items, and vehicles
Store photos and documentation of your belongings
Track estimated values for insurance purposes
Share household inventories with family members
Generate reports and exports for insurance claims
Sync data across multiple devices

3. User Responsibilities

3.1 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

Immediately notify us of any unauthorized use of your account
Use strong, unique passwords and enable two-factor authentication when available
Keep your contact information current and accurate
Be responsible for all charges incurred through your account

3.2 Acceptable Use

You agree not to use AItemizeIT to:

Violate any applicable laws or regulations
Infringe on intellectual property rights
Transmit harmful, offensive, or inappropriate content
Attempt to gain unauthorized access to our systems
Interfere with the proper functioning of the service

4. Data Ownership and Responsibility

You retain full ownership of all data and content you upload to AItemizeIT. However, you are solely responsible for:

The accuracy and completeness of your inventory data
Ensuring you have proper legal rights to any photos or documents you upload
Backing up your data regularly
Complying with all applicable data protection laws
The security of your account and data

We are not responsible for any loss, corruption, or unauthorized access to your data.

5. Service Availability and Changes

While we strive for high availability, AItemizeIT is provided "as is" and "as available." We do not guarantee:

Uninterrupted or error-free service
That all features will function as expected
That your data will never be lost or corrupted
Specific uptime percentages

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice. We will make reasonable efforts to provide advance notice for significant changes.

6. Limitation of Liability

To the maximum extent permitted by law, AItemizeIT and its affiliates shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Service interruptions or data loss
Third-party claims or disputes
Any damages exceeding the amount you paid us in the 12 months preceding the claim

You use AItemizeIT at your own risk. We provide no warranties regarding data security, accuracy, or reliability.

7. Warranties and Disclaimers

7.1 Service Warranty

AItemizeIT is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, including but not limited to:

Merchantability or fitness for a particular purpose
Accuracy, reliability, or completeness of the service
Security or protection against data loss
Compatibility with all devices or systems
Freedom from viruses or other harmful code

7.2 Insurance Warranty

AItemizeIT does NOT guarantee that your inventory documentation will be accepted by any insurance company, result in favorable claim outcomes, or meet specific insurance requirements. Insurance coverage and claims decisions remain entirely at the discretion of your insurance provider.

Always consult with licensed insurance professionals for coverage advice and claims assistance.

8. Indemnification

You agree to indemnify, defend, and hold harmless AItemizeIT, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

Your use of the service
Violation of these Terms
Violation of applicable laws or regulations
Infringement of third-party rights
Any content you upload or share

9. Termination

9.1 Termination by User

You may terminate your account at any time. Upon termination, we will delete your account and associated data within 30 days, subject to any legal retention requirements.

9.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, for violation of these Terms. Upon termination:

Your access to the service will cease
We may delete your account and data
Outstanding payments are still due
These Terms survive termination

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to conflict of law principles. Notwithstanding the foregoing, you acknowledge that we operate internationally and that applicable local laws may apply to certain aspects of our service in your jurisdiction.

10.2 International Users

If you are accessing AItemizeIT from outside the United States, you agree that any disputes, claims, or controversies arising out of or relating to these Terms or the service shall be subject to the exclusive jurisdiction of the courts located in Delaware, USA. You hereby waive any right to participate in class action lawsuits or class-wide arbitration.

We make no representation that AItemizeIT is appropriate or available for use in all jurisdictions. Access to AItemizeIT from territories where the content is illegal is prohibited.

10.3 Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Delaware, USA, and the arbitrator's decision shall be final and binding.

10.4 Severability

If any provision of these Terms is found to be unenforceable in any jurisdiction, such provision shall be modified to make it enforceable to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

10.5 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the service, constitute the entire agreement between you and AItemizeIT concerning the service.
